FAQs About Your Rights, Claims & Compensation

1. How much is my personal injury case worth in South Carolina? There is no fixed amount for a personal injury case. The value depends on factors such as the severity of your injuries, medical expenses, lost wages, pain and suffering, and the at-fault party’s insurance coverage. Every case is unique. At JCLF, we evaluate all damages to help you pursue the maximum compensation allowed under South Carolina law.

2. Do I have to go to court for a car accident lawsuit? Not necessarily. Most personal injury cases settle without going to court. However, if the insurance company refuses to offer a fair settlement, filing a lawsuit may be necessary. Our attorney prepares every case as if it’s going to trial, to maximize your leverage during negotiations.

3. What should I do immediately after a car accident in South Carolina? First, call 911 and seek medical attention, even if injuries seem minor. Then, document the scene with photos, exchange insurance information, and get a copy of the police report. Do not admit fault. 4. How long do I have to file a personal injury claim in South Carolina? South Carolina’s statute of limitations for personal injury claims is three years from the date of the accident (SC Code § 15-3-530). If you fail to file in time, you may lose your right to recover compensation. Don’t wait—contact our office as soon as possible.

5. What if the other driver doesn’t have insurance? You may still be covered under your own auto policy through uninsured or underinsured motorist (UM/UIM) coverage. Our team can help you navigate your policy and identify all possible sources of compensation.

6. How is fault determined in a South Carolina car accident? South Carolina uses a modified comparative negligence rule. That means fault is assigned by percentage, and you can recover damages as long as you are not more than 50% at fault. Your compensation will be reduced by your percentage of fault.

7. Can I still recover compensation if I was partially at fault? Yes. As long as you are found to be 50% or less at fault, you can still recover compensation. For example, if you are awarded $100,000 but were 30% at fault, you would receive $70,000.

8. How long will my personal injury case take to settle? It depends. Some cases resolve in a few months; others take over a year. Factors include the complexity of the case, medical treatment duration, and the insurance company’s willingness to negotiate.
